What is a fideicomiso?
The fideicomiso is a bank trust that allows a foreigner to acquire property inside the restricted zone: 50 km from the coast and 100 km from the borders. The bank acts as trustee, but the buyer remains the sole beneficiary: you can live in the property, rent it, renovate it, sell it or pass it on to your heirs.
Why it secures your purchase
The contract is registered with the Ministry of Foreign Affairs and recorded in the public property registry. It runs for 50 years and is renewable indefinitely. The property never sits on the bank's balance sheet: should the bank fail, your rights remain intact and the trust is simply transferred to another institution.
Steps before signing
Title and lien verification, permit from the Ministry of Foreign Affairs, opening the trust with the chosen bank, then signing before a public notary. Expect four to eight weeks between the purchase offer and closing, depending on the developer and the bank.
Costs to plan for
Trust set-up fee, annual bank administration fee, notary fees, acquisition tax and registration costs. We always provide a detailed estimate before the offer so nothing surprises you at closing.
How we support you
We coordinate the bank, the notary and the lawyer, review every clause and stay with you until the keys are handed over. You never negotiate alone in a language or legal framework that isn't your own.
